3. Account Registration

To use our services, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account

You are responsible for all activities that occur under your account.

4. Subscription and Payment

Fees

Subscription fees are charged monthly or annually as selected during registration. All fees are quoted in U.S. dollars and are non-refundable except as expressly provided in these Terms.

Billing

By providing payment information, you authorize us to charge your payment method for the subscription plan you selected. Subscriptions automatically renew unless cancelled before the renewal date.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

5. Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to our systems

• Resell or redistribute our services without authorization

6. Insurance Industry Compliance

You acknowledge that:

• You are responsible for maintaining all required insurance licenses
• You will comply with all applicable insurance laws and regulations
• Sunsure is a technology provider and does not provide insurance advice
• Final underwriting decisions are made by insurance carriers, not sunsure
• You remain responsible for the accuracy of information submitted through our platform

7. Intellectual Property

All content, features, and functionality of our services, including but not limited to software, text, graphics, logos, and trademarks, are owned by sunsure and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. Data and Privacy

Your use of our services is also governed by our Privacy Policy. You grant us a license to use data you provide through our services to operate and improve our platform. You represent that you have obtained all necessary consents to share customer information through our platform.

9. Third-Party Services

Our services integrate with third-party carrier systems and APIs. We are not responsible for the availability, accuracy, or performance of third-party services. Your use of carrier portals and systems is subject to those carriers' terms and conditions.

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNSURE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless sunsure, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to our services at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination shall survive.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Miami-Dade County, Florida.

16. Dispute Resolution

Any dispute arising from these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Miami, Florida, in accordance with the rules of the American Arbitration Association.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and sunsure regarding your use of our services and supersede any prior agreements.
